Terms of Service
Black Canyon Performance European Auto Service Terms of Service
These terms apply to services performed by Black Canyon Performance (“BCP”). Nothing in these terms limits rights that cannot be waived under applicable law.
Estimates and authorization
BCP will provide an estimate and obtain your authorization before performing repairs as required by law. If additional work or parts are needed, we will contact you for authorization before proceeding as required by law.
Diagnostics use professional judgment and available information. Some conditions may not become apparent until further testing, disassembly, or repair. A repair addresses the specific condition identified and does not guarantee that unrelated issues will not arise.
3-year/36,000-mile limited warranty
BCP warrants its workmanship and the parts it supplies and installs against defects for 3 years or 36,000 miles, whichever comes first. Coverage begins on the completed repair date and at the mileage shown on the original invoice and applies only to the parts and services listed on that invoice.
Some repairs or components, including engines, transmissions, and other assemblies, may have different coverage based on the supplier. Any different terms, including whether parts and labor are covered, will be disclosed before you authorize the work and documented on the estimate and invoice. Those terms apply to the identified repair or component instead of the standard warranty.
To request warranty service, contact BCP before authorizing repairs elsewhere. We generally require the vehicle to be returned to BCP for inspection and any covered repair. If you are traveling or cannot reasonably return the vehicle, contact us to discuss options. Repairs performed elsewhere require BCP’s prior authorization for reimbursement, except where applicable law provides otherwise.
Our usual remedy for a covered claim is repair or replacement of the covered part or correction of the covered workmanship. A warranty repair does not restart the original warranty period unless BCP agrees otherwise in writing.
The warranty does not cover:
- Damage or failure caused by accidents, misuse, neglect, lack of required maintenance, overheating, or continued operation after a warning or known problem.
- Failures caused by a preexisting modification, incompatible component, or work performed by another party. A modification or outside repair does not automatically exclude an unrelated BCP repair.
- Normal wear or routine replacement of fluids, filters, brakes, tires, wiper blades, and other maintenance items. Defects in BCP-supplied parts or workmanship remain covered.
- Customer-supplied parts or the cost of diagnosing, removing, or replacing a defective or incompatible customer-supplied part.
- Towing, rental vehicles, lodging, lost time, or other incidental expenses, except where required by law or approved by BCP in advance.
If a concern is not covered, diagnostic or repair charges may apply. We will discuss applicable charges before proceeding as required by law.
Customer-supplied parts and modified vehicles
BCP may decline work or customer-supplied parts we believe are unsafe, unlawful, or unsuitable. You are responsible for the selection, condition, quality, and compatibility of parts you provide. Any warranty on those parts is provided by their seller or manufacturer; BCP’s installation workmanship remains covered under our labor warranty. Inspection cannot guarantee a part is free of defects or suitable for the vehicle.
Please tell us about known modifications before service. Existing modifications may affect diagnosis, repairs, compatibility, cost, or timing and may not be readily visible. We will obtain authorization for additional work or charges as required by law.
Emissions and performance
BCP will not knowingly perform work or install products that violate applicable emissions or vehicle laws. Some performance products may not be legal for use on certain vehicles or in certain locations. Product labeling alone does not establish that an installation is lawful. We may decline an installation we believe is unlawful or inappropriate.
Vehicle operation and care
You authorize qualified BCP employees to operate your vehicle as reasonably necessary for diagnosis, testing, inspection, repair, verification, and transportation to or from an authorized third-party service provider. Please inform us in writing of any operating restrictions or known safety concerns before leaving your vehicle.
BCP will use reasonable care while your vehicle is in our possession. Theft, fire, hail, and other events may occur outside our reasonable control. Nothing in these terms releases BCP from responsibility for its own negligence.
Please remove valuables and personal property not needed for service. BCP is not responsible for loss of personal property resulting from events outside our reasonable control.
Storage and pickup
STORAGE FEE: $30 PER DAY
Storage fees may apply when a vehicle is not picked up after repairs are complete or remains at BCP after an estimate has been provided and repairs have not been authorized. Fees begin only after the applicable notice and waiting periods required by Colorado law.
A storage fee may be charged, beginning on the fourth day, if a motor vehicle is not removed within three days after the customer is notified that repairs have been completed, excluding Saturdays, Sundays, legal holidays, and any days the repair facility is closed for business.
We will notify you when your vehicle is ready. Please contact us if you need to arrange a later pickup. If authorized charges remain unpaid or a vehicle is not picked up, BCP may exercise applicable lien or other rights in accordance with Colorado law. We may request proof of ownership or authorization before releasing a vehicle.
Replaced parts
You may request the return of replaced parts when you authorize repairs, subject to exceptions under Colorado law, including certain warranty, exchange, and body-shop parts. Certain excluded parts may be available for examination.
